The Supreme Court of New Mexico has issued an order adopting new rules in effect for all foreclosure cases filed on or after September 7, 2021. The new rules include new pre-filing and pre-judgment Certification requirements, as well as a pre-filing notice that must be provided to the borrower.

A Certification that the required pre-filing notice was provided must be submitted with the complaint. The Certification will further confirm which of the CFPB Final Rules Procedural Safeguard exceptions apply to the loan. Any complaint submitted for filing without the Certification in the required form will not be accepted by the clerk. Additionally, the new rules require a Certification be filed prior to entry of judgment, which confirms the status of any loan modification and loss mitigation negotiations with the borrower.

here are no state specific foreclosure or foreclosure related eviction moratoriums in place.  A moratorium on landlord-tenant evictions is in place.  There is no moratorium on evictions of foreclosed homeowners.
