Residential evictions still prohibited in Seattle through January 15, 2022

Certain Washington State cities and counties may have their own eviction restrictions. The City of Seattle, for instance, has implemented executive order 2021-07, which prohibits residential evictions residential evictions through January 15, 2022. Thereafter, Ordinance 126075 will take effect until July 15, 2022, which provides a defense against eviction on the basis of COVID-19 related hardships. Before bringing an eviction action, confirm whether there are any local restrictions in the municipality and county in which the real property is located.

Post-foreclosure eviction actions may otherwise proceed

All other allowable evictions under ESHB 1236 and RCW 59.18 may proceed. There are no state-level restrictions in place at this time on either foreclosure actions or post-foreclosure evictions.

On October 8, 2020, the Washington governor extended the proclamation regarding restrictions on evictions throughout the remainder of the 2020 calendar year. This ongoing restriction prevents eviction actions unless the property owner is able to show applicability of one of the two following exceptions: 1) that the action is necessary to respond to an immediate risk to health, safety, or property of others or the tenant; or, 2) that 60 days written notice is provided to the occupants that the property owner intends to either occupy the property as a personal residence or otherwise sell the property.

There is no specified foreclosure/eviction moratorium in the State of WA beyond the CARES Act. 

A statewide proclamation from the governor restricting evictions is currently in place until October 15, 2020 unless extended further by the governor.  The restriction prevents eviction actions unless the property owner is able to show applicability of certain exceptions:  the action is necessary to respond to an immediate risk to health, safety, or property of others or the tenant is provided 60 days written notice that the owner intends to occupy the property as a personal residence or sell the property.
