New Jersey’s restriction on post-foreclosure and tenant evictions is ongoing until the end of Governor Murphy declared public emergency.  There is presently no other restriction on foreclosures in New Jersey.  However, most sheriff’s offices are interpreting the Governor’s Executive Order and declaration to mean that there are to be no foreclosure sales until the end the Governor ends the public health emergency.

On August 1, 2020, Governor Murphy extended his declaration of public health emergency indefinitely.  As such, New Jersey’s restriction on post-foreclosure and tenant evictions is also extended.  There is presently no other restriction on foreclosures in New Jersey.  However, most sheriff’s offices are interpreting the Governor’s Executive Order and declaration to mean that there are to be no foreclosure sales until the end the Governor ends the public health emergency.

On June 25, 2020 the New Jersey Supreme Court executed Fifth Omnibus Order which continues certain suspensions and extensions through July 12. 2020 and affirms that other provisions remain in full force and effect. The Order concludes restrictions on the Office of Foreclosure which includes reviewing Judgments or dispositive motions received on or after March 1, 2020.

FNMA, FHLMC, HUD, VA & USDA have a foreclosure and eviction moratorium in place until  June 30, 2020.

The Governor of the State of New Jersey issued an executive emergency order (151) on March 19, 2020  which was extended 30 days on June 4, 2020. The Office of Foreclosure will not review or recommend motions or judgments received on or after March 1, 2020 pending further court order. Eviction moratorium started March 19, 2020 and will remain in place until two months after Governor Murphy declares an end to the crisis.
